1. Acceptance of Terms
By accessing or using PermitIQ ("the Service"), a product of TekStream Solutions ("we," "us," or "the Company"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and TekStream Solutions governing your use of the Service.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. In such cases, "you" and "your" will refer to both you as an individual and the organization you represent.
If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
2. Description of Service
PermitIQ is an artificial intelligence-powered permit completeness checking platform designed to assist building departments, permit applicants, and construction professionals. The Service analyzes submitted documents against applicable building codes, permit requirements, and jurisdictional regulations to identify potential gaps or issues before formal permit submission.
The Service provides automated document analysis, completeness scoring, code compliance checks, and recommendations for improving permit applications. PermitIQ is designed as a pre-submittal tool to help users prepare more complete applications, potentially reducing review cycles and improving approval timelines.
Important: The AI-generated analysis provided by PermitIQ is advisory only and does not constitute official permit review. The Service does not replace the formal review process conducted by building departments and licensed professionals. PermitIQ does not guarantee permit approval, and users should not rely solely on the Service's analysis for final permit decisions.
Final determinations regarding permit approval, code compliance, and building safety remain the exclusive responsibility of the appropriate government authorities and licensed professionals. Users are encouraged to consult with qualified architects, engineers, and local building officials regarding their specific permit requirements.
3. User Accounts
To access certain features of the Service, you must register for an account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years of age to create an account. If you are creating an account on behalf of a company or organization, you represent that you have the legal authority to bind that entity to these Terms. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
We reserve the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or engage in fraudulent or abusive behavior. You may not share your account credentials with others or allow others to access your account. Each user must maintain their own individual account.
Government agency accounts are subject to additional verification requirements. Accounts associated with building departments or other government entities may be granted elevated privileges and access to administrative features as determined by TekStream Solutions.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service complies with all applicable federal, state, and local laws and regulations, including those related to building permits, construction, and professional licensing.
You agree NOT to:
- Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service
- Use the Service to transmit any viruses, malware, or other malicious code
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to reverse engineer, decompile, or disassemble any portion of the Service
- Use automated scripts, bots, or other means to access the Service without our express written permission
- Upload documents containing illegal, defamatory, or infringing content
- Misrepresent your identity or affiliation with any person or organization
- Use the Service to engage in any activity that is fraudulent, deceptive, or harmful
We reserve the right to investigate and take appropriate legal action against anyone who violates this section, including removing content, suspending accounts, and reporting violations to law enforcement authorities.
5. Intellectual Property
The Service, including all software, algorithms, user interfaces, designs, text, graphics, logos, and other content (excluding User Content as defined below), is owned by TekStream Solutions or its licensors and is protected by copyright, trademark, and other intellectual property laws of the United States and other jurisdictions.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. This license does not include the right to sublicense, modify, distribute, or create derivative works based on the Service.
You retain ownership of all documents and content you upload to the Service ("User Content"). By uploading User Content, you grant TekStream Solutions a limited license to process, analyze, and store your content solely for the purpose of providing the Service. AI-generated analysis reports and recommendations are provided to you under a license for your internal use only.
The PermitIQ name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TekStream Solutions. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.
6. User Content and Data
You are solely responsible for the accuracy, completeness, and legality of all documents and content you upload to the Service ("User Content"). You represent and warrant that you have all necessary rights to submit User Content and that your submission does not violate any third-party rights, including intellectual property rights, privacy rights, or confidentiality obligations.
By uploading User Content, you grant TekStream Solutions a non-exclusive, worldwide, royalty-free license to use, process, store, and analyze your content for the following purposes: (a) providing and improving the Service; (b) developing and training AI models (using anonymized or aggregated data only); and (c) generating analytical insights and reports for your use.
We implement reasonable security measures to protect User Content. However, you acknowledge that no method of electronic storage or transmission is completely secure. You are responsible for maintaining backup copies of your User Content.
Anonymized and aggregated data derived from User Content may be retained and used to improve the Service, develop new features, and generate industry insights. Such data will not identify you or any specific project.
7. Privacy and Data Protection
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
PermitIQ uses artificial intelligence systems to analyze documents and provide recommendations. Your documents may be processed by third-party AI service providers (including Anthropic and OpenAI) pursuant to data processing agreements that require these providers to protect your information and restrict its use.
For users submitting documents to government agencies through the Service, please note that information submitted to government entities may become public records subject to applicable public records laws, including the Florida Public Records Act (Chapter 119, Florida Statutes). See the Florida Public Records Notice at the bottom of this page for more information.
8. Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
TekStream Solutions does not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) the AI-generated analysis, results, or recommendations will be accurate, complete, or reliable; (d) any defects in the Service will be corrected; or (e) the Service will result in permit approval or compliance with any building code or regulation.
The Service is intended as a preliminary checking tool and does not replace professional review by licensed architects, engineers, or building officials. You acknowledge that AI technology has inherent limitations and may produce errors or inaccurate results. You are solely responsible for verifying all AI-generated recommendations and making independent decisions regarding your permit applications.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TEKSTREAM SOLUTIONS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Permit denials, delays, or additional costs resulting from reliance on the Service
- Errors, inaccuracies, or omissions in AI-generated analysis or recommendations
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US FOR USE OF THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100).
THE LIMITATIONS OF THIS SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE.
10. Indemnification
You agree to defend, indemnify, and hold harmless TekStream Solutions, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your use of and access to the Service
- Your violation of any term of these Terms
- Your violation of any third-party right, including any intellectual property, property, or privacy right
- Any claim that your User Content caused damage to a third party
- Your violation of any applicable law, rule, or regulation
This defense and indemnification obligation will survive these Terms and your use of the Service. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.
We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it. However, our failure to provide such notice shall not relieve you of your indemnification obligations except to the extent that such failure materially prejudices your ability to defend the claim.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
You may terminate your account at any time by discontinuing use of the Service and contacting us to request account deletion. Upon termination, we will delete your account and associated data in accordance with our Privacy Policy and applicable data retention requirements.
The following provisions shall survive termination: Sections 5 (Intellectual Property), 6 (User Content and Data), 8 (Disclaimers and Warranties), 9 (Limitation of Liability), 10 (Indemnification), and 12 (General Provisions), as well as any other provisions that by their nature should survive termination.
For government agency accounts, termination procedures may be subject to additional requirements specified in applicable service agreements. Government users should contact their agency administrator for information about account termination procedures.
12. General Provisions
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Miami-Dade County, Florida.
Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity of the remaining provisions.
Entire Agreement: These Terms, together with the Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and TekStream Solutions concerning the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

PermitIQ is used by Florida government agencies. Under Chapter 119, Florida Statutes (Florida Public Records Act), information submitted to government agencies through this platform may be subject to public records requests.
Under Florida law, e-mail addresses are public records. If you do not want your e-mail address released in response to a public records request, do not send electronic mail to government agencies using this system.
Certain information may be exempt from public disclosure under Florida law, including but not limited to: trade secrets, proprietary business information, and certain personal identifying information. Contact your local government agency for specific exemption information.
